The interesting bit is that within your account preferences, you can specify which fruit and veg you dislike, which you don’t mind, and which you love, all with an easy smiley face matrix. Then the system takes these into account when filling your box each week so you get the stuff you love if it’s available (like blueberries and squash for me) and never the stuff I hate (like brussel sprouts).

What’s cool is that you can specify groups all at once, so if you dislike all berries, you can choose to exclude all of them at once, or just exclude strawberries put keep all other berries, and you can set up temporary exclusions, like if you have a ton of apples on hand already and don’t need any more for this week’s delivery.

I just thought this was such a great way to get across quite complicated information about each person’s food foibles, and it was done in such a clear and simple way.

Ow my eyes! I would probably organize the Gizmo Project feature details list like so:

Abel & Cole are pretty good on the human-side of the service too. A great site’s not going to help if you can’t fulfil on the service. The delivery drivers are happy to keep keys for lockable storage boxes, as theft of the boxes is sadly all too common in London. They resolve problems fast and normally compensate for problems with free goodies.

They went through a dodgy patch a while ago as they experienced a very quick expansion of customer numbers, but they handled it well. Honest and straightfoward communication about the issue, a commitment to sorting it out, and then going on to fix it.

PS: my problem with brussel sprouts is that they are clearly Satan’s vegetable.

Brussels sprouts are utterly delish if you cook them al dente with bacon and or chestnuts and dress with decent butter, salt, pepper. They are completely vile and stinky if you overcook them and lob em on a plate. Most people had them made the latter way when they were kids and formed a strong prejudice.

Love that iSquint help menu. I just saw that the other day – glad someone thought to send it in!

Clods of dirt would be delish if you cooked them with bacon, chestnuts, butter, and salt. At that point, you’re just providing something to hold that salt and fat together.

Abel and Cole also ran a very well designed paper flyer. They got my business just off the back of that. Will see if I can find and share.

Without a way to automate his inventory, Randy Jacobs spent all of his time and energy 3 eBay stores. There was simply no time to grow sales and expanding to new marketplaces. Ramaswamy Parameswaran v. M/s. Ebay India & Gizmo Technology

(By Sri T.Simhachalam, Honble President on behalf of the bench) This complaint is filed on behalf of the complainant under Section 12 of C.P. Act of 1986 requesting this Forum to direct the opposite parties to grant the following reliefs:

1. To reimburse a sum of Rs.25,999/- the cost of Apple i-Phone

2. To pay Rs.2,00,000/- towards compensation

3. To pay Rs.1,00,000/- for wrong supply if the i-Phone bearing IMEI no matching with their box

4. To pay Rs.10,000/- towards costs. Brief facts of the case of the complainant are as follows :- The complainant purchased brand new i-Phone model 5s 32G bearing IMEI No.358777052299048 on 21.01.2016 through online from Hyderabad and the opposite party no.1 & 2 has handed over the said phone to the complainant at his residence situated at S.V.s Shriyans Apartments, Chikkoti Garden, Begumpet, Hyderabad and the complainant paid an amount of Rs.25,999/- through online payment to opposite party no.1 and the same was supplied by opposite party no.2 and after some days the charger of the said i-Phone became defective and it was brought to the notice of the opposite party no.2 through email on 18.04.2016 and the opposite parties contacted him on 26.04.2016, they can only provide Rs.1,000/- ebay coupon which can be used in ebay.in online purchase and the complainant had agreed for that and accordingly the coupon details were sent on 28.04.2016. In the meantime the phone was experiencing no Signal problem frequently and the signal was coming ON and OFF often and the complainant took the i-Phone to Airtel on 05.05.2016 and they had immediately changed new SIM and given to the complainant and on the next day morning i.e., 06.05.2016 again the complainant experienced No Signal problem in the phone and they informed the complainant to take up this matter with the supplier and the same was informed to the servicing centre of the opposite parties. Then on 09.05.2016 Mr.Ashwini asked the complainant to take the front and back photo image of the actual i-Phone which was sent by the opposite parties and while taking the photo images the front and back of the actual i-Phone supplied by the opposite parties the complainant got the shock of seeing IMEI no. of the actual i-Phone supplied is totally different from the IMEI No. ordered through ebay in online purchase and the ebay in order statement invoice. The IMEI No. in the actual i-Phone supplied is 357991050933117 and the IMEI No. in the ebay order statement is 358777052299048 which was ordered through ebay in online payment via portal id : paisa pay id : 41700563004. Then the complainant had brought it to the notice of Mr.Ashwini and informed to the opposite parties and made representation to higher officers about the fraud committed by the opposite parties and on 17.05.2016 the complainant had returned Rs.1,000/- ebay.in coupon through email and the complainant requested the opposite parties to substitute the new piece in place of old piece or return the cost of the i-Phone but the opposite parties failed to do so, hence filed this complaint. Opposite party no.1 & 2 were called absent set exparte. Evidence Affidavit of complainant filed and got marked Ex.A1 to A38. Written arguments of complainant filed. Oral arguments heard. On the basis of the pleadings, documents, evidence affidavit and arguments the following points are necessary for determination : Points for consideration are:

1. Whether this Forum has got Territorial and pecuniary jurisdiction to decide the complaint?

2. Whether there was any deficiency in service or unfair trade practice on the part of the opposite party as complained in the complaint?

3. Whether the complainant is entitled the reliefs as prayed for?

4. To what relief? Point No.1 :- The complainant purchased the i-Phone through online from Hyderabad, the amount is paid through online and the amount was debited from complainants bank account at Hyderabad and the i-Phone was supplied by opposite party no.2 to the complainants house at Hyderabad therefore this Forum has got territorial jurisdiction to decide the complaint. As per the judgement reported in M.D.Air Deccan Vs Shri Ram Gopal Agarwal on 07.12.2013 Meghalaya State Consumer Disputes Redressal Commission :

23. We shall also bear in mind that the Honble Supreme Court held in para 17 of Dr.V.N.Shirkhande Vs Anitha Sena Fernandes (AIR 2011 SC 212) that where the term cause of action has not been defined in an Act, the same has to be interpreted keeping in view the context in which it has been used and object of the legislation. Again, explaining the term cause of action it observed in paras 16 &

17 of Rajasthan High Court Advocates Assn. Vs Union of India (AIR 2001 SC 416) that it would be open to a litigant who is the dominus litus to have his forum conveniens and he has the right to go to a court where part of his cause of action arises. Further that, it has to be left to be determined in each individual case as to where the cause of action arises.

24. To our mind the celebrated judgement of the Honble Supreme Court viz ABC Laminart PVt Ltd., Vs A.P.Agencies, Salem (AIR 1989 SC 1239) read along with the provisions of the Information Technology Act, 2000 which we shall discuss later, is of vital value and relevance to decide this matter which is not as complicated as it appears to be at first glance. What the Honble Apex Court held here in paras 13 to 15 is required to be quoted below expansively (underlining ours) (13) Under Section 20 (C) of the Code of Civil Procedure subject to the limitation stated theretofore, every suit shall be instituted in a court within the local limits of whose jurisdiction the cause of action, wholly or in part arises. It may be remembered that earlier section 7 of Act 7 of 1888 added Explanation III as under. Explanation III In suits arising out of contract the cause of action arises within the meaning of this Section at any of the following places, namely (1) the place where the contract was made (2) the place where the contract was to be performed or performance thereof completed (3) the place where in performance of the contract any money to which the suit relates was expressly or impliedly payable. (14) The above Explanation III has now been omitted but nevertheless it may serve a guide. There must be a connecting factor. (15) In the matter of a contract there may arise causes of action of various kinds. In a suit for damages for breach of contract the cause of action consists of the making of the contract, and of its breach, so that the suit may be filed either at the place where the contract was made or at the place where it should have been performed and the breach occurred. The making of the contract is part of the cause of action. A suit on a contract, therefore, can be filed at the place where it was made. The determination of the place where the contract was made is part of the Law of Contract. But making of an offer on a particular place where the contract was made is part of the Law of Contract. But making of an offer on a particular place does not form cause of action in a suit for damages for breach of contract. Ordinarily, acceptance of an offer and its intimation result in a contract and hence a suit can be filed in a court within whose jurisdiction the acceptance was communicated. The performance of a contract is part of cause of action and a suit in respect of the breach can always be filed at the place where the contract should have (been) performed or its performance completed. If the contract is to be performed at the place where it is made, the suit on the contract is to be filed there and nowhere else. In suits for agency actions the cause of action arises at the place where the contract of agency was made or the place where actions are to be rendered and payment is to be made by the agent. Part of cause of action arises where money is expressly or impliedly payable under a contract. In case of repudiation of a contract, the place where repudiation is received is the place where the suit would lie. If a contract is pleaded as part of the cause of action giving jurisdiction to the Court where the suit is filed and that contract is found to be invalid, such part of cause of action disappears. The above are some of the connecting factors.

25. The ratio of its extremely relevant and landmark judgement of the Honble Supreme Court, as we can understand, is that, in contractual matters, besides other places, cause of action arises at any of the places where (a) a contract is made or (b) where acceptance of a contract is communicated or (c) where a contract is performed or is to be performed or (d) where money under the contract is either payable or paid; or (e) where repudiation of a contract is received. Section 11 (2) of the CP Act being akin to Section 20 C.P.C., this clear pronouncement of the law relating to territorial jurisdiction would apply with full force to the Consumer For a and is thus instrumental in helping us resolve the issue with which we are confronted.

26. Further, to clear any doubts that may arise about the applicability of the Contract Act to proceedings in the Consumer Fora, we wish to cite Marine Container Services South Vs Go Go Garments (AIR 1999 SC 80) (Para 4) wherein the Honble Apex Court stated We are not a little surprised to read that the Contract Act does not apply to complaints filed under the Consumer Protection Act. The Contract Act applies to all, litigants before the Commission under the Consumer Protection Act included. Equally appropriate it is to cite the decision of the Honble National Commission in Indian Airlines Vs S.N.Seth (First Appeal No.495 of 1997) where it rules that Issuing air ticket on behalf of the Indian Airlines a contract has been entered into between Seth and Indian Airlines.

27. In this view of the matter, we therefore hold that, for the purposes of Consumer complaints relating to normal contracts for services and / or goods, cause of action arises inter alia at any of the places where (a) the contract is made; or (b) where acceptance of the contract is communicated or (c) where the contract is performed or is to be performed or (d) where money under the contract is either payable or paid or (e) where repudiation of the contract is received, if any. Consequently, territorial jurisdiction over a consumer complaint also lies with the Consumer Fora situated at any place where any of the aforementioned causes of action arises. Hence, besides other places where a consumer may choose to file a complaint in accordance with Section 11 (2) of the CP Act, a consumer will be legally entitled to pursue his remedy before any Consumer Fora with appropriate pecuniary powers, holding territorial jurisdiction over any of the aforementioned places. The above judgement is applicable to the facts of the case on hand. In that case the complainant booked two air tickets from the opposite party airlines over internet from Shilong and made payment through credit card for himself and his wife for a journey from Delhi to Jaipur on 04.04.2006 in Flight No.DN/511. Before boarding the aforesaid flight at Delhi domestic airport, the complainant with his wife booked their personal baggage with Gat No.114185 and 114184. But on reaching Jaipur, to the complainants utter dismay it was found that the booked baggage was missing and the complainant immediately informed to the opposite party but opposite party did not take any action. Hence filed the complaint before the District Forum at Shillong claiming compensation. The Honble District Court allowed the complaint and the opposite party preferred appeal. The appeal preferred by the opposite party is dismissed on the ground the Consumer Protection Act is a beneficial legislation and the complainant booked airline ticket through online, therefore the place where the complainant is residing and booked the tickets has got jurisdiction. Hence the above judgement is applicable to the facts of case on hand because the complainant purchased i-Phone through online payment made at Hyderabad and delivery of the i-phone is made at complainants residence at Hyderabad and the amount claimed is below Rs.20.00 Lakhs. Therefore this Forum has got territorial and pecuniary jurisdiction to decide the complaint. Point No.2 & 3: As per evidence the complainant filed Ex.A1 to A38 and marked the documents on his behalf. The following points are admitted or proved :

1. As per Ex.A2 the complainant paid Rs.25,999/- as per order statement and he received the i-phone on 21.01.2016 and then three months from the date of purchase i.e., on 18.04.2016 the complainant informed the opposite party no.2 that the charger of the said i-phone became defective and the opposite parties informed to the complainant on 26.04.2016 that they cannot change the defective charger but they can only provide Rs.1,000/- ebay coupon which can be used in ebay.in online purchase and the complainant agreed for the same

2. As per the pleadings and evidence affidavit the complainant took the i- phone to Airtel on 05.05.2016 they had immediately changed the new SIM and given to the complainant and the complainant experienced that No Signal problem. On 09.05.2016 informed to the opposite parties and as per the directions of the employees of the opposite parties while taking the photo images of the front and back side of i-phone supplied by the opposite parties, he noticed that the IMEI No. in actual i-phone supplied to the complainant is different from the IMEI No. given in ebay order statement.

3. The same was brought to the notice of the opposite parties but the opposite parties failed to pay the cost of the defective i-phone.

4. Evidence affidavit filed on behalf of complainant is corroborating the pleadings. Therefore as per the evidence it is clear the i-phone supplied to the complainant is contrary to the i-phone IMEI No. mentioned in the order statement.

5. I-phone supplied by the opposite party is defective one. The complainant approached the opposite parties within the period of warranty and the complainant also filed this complaint within the period of warranty

6. As per the evidence the complainant made number of correspondence to the opposite parties customer care services as well as made number of representations to the concerned authorities.

7. The opposite party no.1 & 2 were called absent. They were set-exparte. There is no rebetal evidence on behalf of the opposite parties to disprove the contents of the complainant.

8. Therefore the complainant proved that the complainant purchased i-phone on 21.01.2016 by paying Rs.25,999/- under Ex.A2 and the said piece was defective one within the warranty period. The complainant approached the opposite parties. The i-phone supplied by the opposite parties is different i- phone. The IMEI No. mentioned in the order statement is different from the actual i-phone supplied by the opposite parties. Therefore the facts and circumstances of the case is taken into consideration, we feel it just and reasonable to direct the opposite parties to pay the cost of the i-phone of Rs.25,999/- and after receiving the said amount the complainant shall return the i-phone to the opposite parties. The complainant is an employee, he approached this Forum no. of times. Therefore the facts and circumstances of the case is taken into consideration we feel it just and reasonable to direct the opposite party no.1 & 2 to pay costs of Rs.2,500/-. Opposite parties are directed to pay the said amount along with 7% interest from the date of this order till payment. Complainant is not entitled any compensation. Hence these points are decided accordingly. Point No.4: In the result, the complaint of the complainant is partly allowed directing opposite party no.1 & 2 jointly and severally :

1. To pay the cost of the i-phone of Rs.25,999/- along with interest @7% P.A. from the date of this order till the date of payment and after receiving the said amount the complainant shall return the i-phone to the opposite party

2. To pay costs of Rs.2,500/-

3. Rest of the claim is dismissed. Time for compliance : 45 days from the date of this order. Dictated to Steno, transcribed and typed by her, corrected and pronounced by us on this the 20th day of February, 2017. Redbox Parent Trialling 'Gizmo' eBay-in-a-Kiosk Concept

Coinstar, which operates the Redbox video kiosks, is trialing several concept kiosks, including "Gizmo, an "eBay-in-a-kiosk" concept, where discounted, refurbished electronic devices will be sold directly to customers.

Coinstar revealed its plans in an analyst meeting on Wednesday, when the company disclosed that it planned a streaming Redbox subscription video service that will debut later in 2011. Coinstar had previously disclosed its streaming plans, but not the form of the service.

Coinstar did not announce a partner for the streaming service, which reports have said may be Amazon.com.

Mitch Lowe, the president of Redbox, told analysts that the company was looking for a partner with access to "quality digital entertainment rights" and a technology platform. Executives also defended the length of the negotiating process, maintaining that the agreement simply required time to complete.

"The way we see it is this bundled product, this bundled subscription product where you get movies at the kiosk and these are -- you can take your choice of what we have, whether it's new releases, Blu-ray, et cetera, movies online, an unlimited streaming product online that supplements what you'd get at the kiosk," Lowe said.

Redbox has tried stocking older, evergreen titles, which give a burst of sales activity. But Lowe, the former vice president of business development at Netflix, said that streaming satisfied consumer demand for older titles.

"Not only do we think it's going to be great for our customer, but we think it's going to extend the life of our physical kiosk-based rentals. And it will do so primarily because it will address this need that customers keep telling us is we'd love more selection," Lowe said. "Give us older, classic titles but give us a lot of those."

Kiosk concepts include "Gizmo"

Coinstar, which installs its own coin-redemption kiosks in addition to the Redbox video-rental stands, also showed off a number of concept kiosks that the company either planned to launch or had installed on a trial basis.

Those automated kiosk concepts include a kiosk that can dispense a "real brewed" cup of coffee, Coinstar executives said, designed by the person who developed the Starbucks stands that are commonly found in grocery stores. Executives also disclosed "Chirp," a kiosk that would sell ladies merchandise to women shopping at grocery stores, with an inventory that would be completely replaced each week.

Coinstar executives also discussed "Face Cube," an Internet-connected photo booth, and EcoATM, a business that Coinstar invested in where older mobile phones and other electronic devices could be disposed of in exchange for cash.

And then there's "Gizmo," a kiosk that would take essentially compete with the Best Buy-branded kiosks that have appeared in airports and other locations, selling high-value electronic merchandise that doesn't take much physical space. Coinstar's target is what the company estimates to be a $150 billion consumer electronic market.

"[O}ne of the things that we've discovered is that there's a significant proportion of consumers in America that have never gone to eBay and will never go to eBay, yet are very interested in buying a consumer electronics device that might be three or four or five months old, may not be right off the assembly line, or may not be just cutting-edge, but they'd get it at a significantly discounted value and that's driving their interest," said Gregg Kaplan, the president and chief operating officer of Coinstar.

"So, for that market opportunity, we created something that we're calling Gizmo," Kaplan added. "And what Gizmo is is exactly what I just said, which is it's used and refurbished consumer electronic products. So think laptops, game consoles, Xboxes, GPS devices, digital cameras, iPads, iPods, those kinds of things, where they're offered at significant discounts. And these are refurbished products which are also guaranteed for a quality perspective, so if you don't like the product, as a consumer, you can return it no questions asked."

Coinstar launched three kiosks in grocery stores before Christmas, Kaplan said, and the design team will put eight to ten more in stores during 2011. The kiosk worked so well that a dummy machine - with absolutely nothing inside it - attracted a level of attention that satisfied the company, he said. He described Gizmo as an "alpha machine," and said the concept would be reworked possibly several times to get the look and feel right.

Face Cube, Chirp, and ecoATM

Coinstar has also launched four "Face Cube" kiosks in malls, where Kaplan said that the company was "very, very happy" with the results, and said that they plan to add about 10 more in 2011. Face Cube kiosks allow customers to take photos against a digital green screen, add their own custom backdrop and logo, print them at up to 8 x 10 sizes, and even post the completed images to Facebook.

Coinstar has also installed 15 Chirp kiosks, where the "find of the week" in everything from handbags to costume jewelry would be promoted to the typical grocery store shopper, which Kaplan said was typically a woman between 25 and 45.

"In the Redbox world, [a sales refresh] happens automatically because movies are coming out every week," Kaplan said. "It brings people coming back. In the Chirp world, we're going to force that refresh. Every week is a new product. It's the new great find of this week that our buyers have gone out and negotiated with the brands that you know and love."

Finally, there's ecoATM, a test of 11 kiosks that can accept a cell phone and exchange it for cash.

"The consumer experience is very, very simple," Kaplan said. "You come up with your cell phone. On the touch screen you let it know that, hey, I have a Blackberry Bold or something like that and note the model number. The machine will ask you to put it in the casing here. They will take a picture of it and compare it to their catalog of several thousand different phones and it can immediately identify it and validate that it truly is, in fact, a Blackberry Bold, and then ask you to plug it in and electronically they can validate that it's working, and, again, that it is the model that you said."

"At that point, the machine will offer you, let me make up a number, $25, at which point you can say yes or no," Kaplan added. "If you say yes, you get cash there right on the spot. The phone itself drops into the bin, and that's the transaction. Or potentially you could get a gift card to the retailer that the machine is located at."
